How do you Qualify?

The Skilled of Australia’s Migration Program is specifically designed to target the migrants who have skills or outstanding abilities that will contribute to the Australian economy. The Australian Government is committed to turn the emphasis of the Migration Program increasingly towards skilled migration, while maintaining a commitment to family reunion migration.
The overall skill level of migrants entering Australia has been increasing in the recent years. The basic requirements for the Skilled Worker are: Age- which should be below 45 years, Proficiency in English and Educational Qualification- which is assessed by the relevant Assessment Authority, suitable for the nominated occupation. The applicant must nominate a skilled occupation which suits his/her skills, qualifications and recent work experience and that occupation must be on the Skilled Occupations List.
If the applicant does not obtain sufficient points for one of the Skilled Visas, then he/she should consider a Matching Visa. This particular Visa is not point tested. An applicant, for a Matching Visa must have been employed in a skilled occupation for at least six months in the twelve months before applying for immigration. The applicant must also satisfy the requirements for skill, be under the age of forty-five years and have proficiency in English language.
To apply for this Visa, the applicants must have their qualifications and experience assessed by an Assessment Authority. If the qualifications and experience are found to be satisfactory, then an application can be filed for the Matching Visa. All the documentation required for a Visa must be lodged at the time of filing the Visa application.
To gain the benefits from this Visa, the applicants must be prepared to initially accept a job anywhere in Australia. A prospective employer will sign a contract with the applicant for a certain period of time. Once that period has expired or is terminated by mutual agreement or otherwise, the client is free to take up a position anywhere in Australia.

Since the geography and culture of Australia is so diverse, the job opportunities available here are incredibly diverse too. You may even be able to gain recognition in Australia for the educational qualifications you have gained, before entering Australia. This will make your employment search even easier. Job vacancies are easy to locate. They are listed in the Jobs or Positions Vacant / Employment sections in Australian newspapers. There are private employment agencies listed in the telephone directory.

The benefits of SkillSelect

SkillSelect is a major change to how Australia manages its skilled migration program.

Skill Select will ensure the skilled migration program is based on the economic needs of Australia. The Australian Government will be able to manage who is able to apply for skilled migration, when they are able to apply and in what numbers, on the basis of this need. As a result, the Department of Immigration and Citizenship expects to significantly reduce the time taken to process a visa application and improve the settlement and employment prospects of its skilled migrants.

SkillSelect will also help address regional skill shortages. SkillSelect allows intending migrants to indicate if they are willing to live and work in regional Australia. This will be of particular benefit to employers experiencing regional skill shortages and state and territory governments attempting to settle migrants in regional Australia.

Skilled Independent (subclass 189) visa

Features

  • This points-based visa is for skilled workers who are not sponsored by an employer, a state or territory, or a family member.
  • A visa holder can live and work permanently anywhere in Australia.
  • Certain family members can be included in the application.

 

Requirements

Applications are by invitation only. To be invited to apply, a person must:

  • Submit an Expression of Interest
  • Have an occupation that is on the relevant skilled occupation list
  • Have a suitable skills assessment for that occupation
  • Be less than 50 years of age when the invitation is issued
  • Meet the English language requirements
  • Be able to score at least 60 on the points test

How this visa works

To be able to lodge a valid application for this visa you need to first submit an Expression of Interest through SkillSelect. You can do this in or outside Australia.

Basic requirements

There are basic requirements you must meet to apply for this visa. You must:

  • Be invited to apply
  • Be younger than 50 years of age when you are invited to apply
  • Nominate an occupation that matches your skills and qualifications and is on the relevant skilled occupation list
  • Have your skills assessed by the relevant assessing authority as suitable for your nominated occupation
  • Have at least competent English
  • Score at least 60 on the points test
  • Meet the health and character requirements.

Include family members

You can include the following family members in your visa application:

  • Your partner
  • Your or your partner’s dependent child
  • Your or your partner’s dependent relative

What the visa costs

The charge for lodging this visa application is AUD3060. This payment covers you and all dependent family members included in your application.
There is an extra charge that applies only to the people on your application who have less than functional English and are 18 years of age or older. The charge is AUD4250 per person. It must be paid before a visa can be granted. The payment covers up to three years of English language instruction through the Adult Migrant English Program.
Proof of functional English explains how your dependants can demonstrate their language ability.
You are responsible for any other costs that you may incur in preparing your application, such as those associated with obtaining skills and English language assessments, health examinations and police certificates.
There are limited circumstances in which visa application charges can be refunded. You will not get a refund if you change your mind about applying.

Entitlements

This visa allows you and your accompanying family members to:

  • Live and work permanently in Australia
  • Study in Australia
  • Enrol in Medicare, Australia’s scheme for health-related care and expenses
  • Access certain social security payments (subject to waiting periods)
  • Apply for Australian citizenship (subject to residency criteria)
  • Sponsor family members for permanent residence

Applying for this visa

If you are invited to apply for this visa, you will then have 60 days in which to lodge your online application. Your invitation letter will explain the lodgment process you should follow. You can be in or outside Australia when you lodge your application.

Invitations are based on claims made in your Expression of Interest at the time you are invited to apply. Your application must reflect the information provided in your Expression of Interest, and be supported by relevant evidence.

If after receiving two invitations to apply for a visa you do not make a visa application your Expression of Interest will be removed from SkillSelect.

Meet health requirements
You and all members of your family unit must meet certain health requirements.
The department will tell you when to arrange health examinations.

Meet character requirements
You and all members of your family unit must meet certain character requirements. This means you and each of your dependants (whether migrating or not) who are aged 16 years or older must provide police certificates. These need to be obtained from each country you and your family members have lived in for 12 months or more over the last 10 years or, in the case of those younger than 26 years or age, since each person turned 16 years of age.
The department will tell you when to arrange police certificates.
Provide biometrics
You may be asked to provide biometrics (a scientific form of identification) as part of your application. Countries and visa subclasses included in the biometrics program has more information.
Enter Australia
If you are outside Australia when this visa is granted, the department will specify the date by which you must enter Australia.

Fulfil employment obligations

There are some obligations that states or territories will require you to meet. These include that you:

  • Stay in that state or territory that nominated you for at least two years
  • Keep the state or territory informed of any changes to your address
  • Complete surveys and provide information when asked.

Business Innovation and Investment (Provisional) (subclass 188) visa

Features

The visa has two streams.

  • The Business Innovation stream is for people who want to own and manage a new or existing business in Australia.
  • The Investor stream is for people who want to make a designated investment in an Australian state or territory and want to maintain business and investment activity in Australia after the original investment has matured.
  • The Significant Investor stream is for people who are willing to invest at least AUD5million into complying investments in Australia and want to maintain business and investment activity in Australia after the original investment has matured.

About this visa

This visa allows you to:

  • Establish a new or develop an existing business in Australia (the Business Innovation stream)
  • Make a designated investment with an Australian state or territory government (the Investor stream)
  • Invest at least AUD5 million in Australia (the Significant Investor stream).

Who can apply?

You can apply for this visa if you:

  • Are invited to apply
  • Have a successful business or investment history
  • Have adequate personal and business assets
  • Were nominated by a state or territory government

The provisional Business Innovation and Investment visa is part of the Australian Business Innovation and Investment Program. You must submit an Expression of Interest through SkillSelect and be invited to apply for this visa.

The visa has three streams:

  • The Business Innovation stream is for people who want to own and manage a new or existing business in Australia.
  • The Investor stream is for people who want to make a designated investment in an Australian state or territory and want to maintain business and investment activity in Australia after the original investment has matured.
  • The Significant Investor stream is for people who are willing to invest at least AUD5 million into complying investments in Australia and want to maintain business and investment activity in Australia after the original investment has matured. Innovation points test

If you are in the Significant Investor stream, the innovation points test does not apply to you.

The innovation points test gives points for various elements of human capital and business innovation. The test also includes objective measures of business performance. It aims to select innovative entrepreneurs who will transfer their skills to Australia and diversify our existing pool of business expertise.

Business Innovation and Investment (Permanent) (subclass 888) visa

Features

The Business Innovation and Investment (Permanent) visa (subclass 888) is the second stage of the Business Innovation and Investment (Provisional) visa (subclass 188). You can apply for it after you have fulfilled the requirements of your provisional visa.

You do not need to submit a new Expression of Interest to apply for this visa.
The visa has two streams:

  • The Business Innovation stream is for people who own and manage a business in Australia
  • The Investor stream is for people who have a designated investment in an Australian state or territory and want to maintain business and/or investment activity in Australia after the original investment has matured.
  • The Significant Investor stream is for people who are willing to maintain business and investment activity in Australia after the original complying investment has matured.

About this visa

This visa allows you to:

  • Continue to own and manage a business in Australia (the Business Innovation stream)
  • Continue business and investment activity in Australia (the Investor stream and theSignificant Investor stream).

Who can apply?

You can apply for this visa if you:

  • Hold a provisional Business Innovation and Investment visa (subclass 188)
  • Have met the requirements of that visa in the stream in which you first applied
  • Are nominated by a state or territory.

About this visa

The Business Innovation and Investment (Permanent) visa (subclass 888) is the second stage of the Business Innovation and Investment visa (subclass 188). You can apply for it after you have fulfilled the requirements of your provisional visa.

You do not need to submit a new Expression of Interest to apply for this visa.
